[36 A.D.2d 934 Page 934] It has already been held that the State Division of Human Rights has jurisdiction in matters involving alleged discrimination
in employment and promotion of faculty members at Queens College (Matter of Board of Higher Educ. v. Carter, 14 N.Y.2d 138).
Should that body overstep the bounds of propriety, exceed its jurisdiction or make any illegal rulings, petitioners shall
be adequately protected by resort to administrative and judicial review. While we do not deem it necessary at this time to
pass upon the applicability of section 300 of the Executive Law, relied upon by petitioners, we note that appellant Lombardo's
second amended complaint, which was verified on December 10, 1969, does contain matter, including charges of retaliation and
ethnic discrimination, which were not before the courts in the article 78 proceeding, [36 A.D.2d 934 Page 935]
